On Friday, Apple responded to Nokia’s patent-infringement suit with a countersuit. Apple charged that Nokia is infringing 13 Apple patents. “Other companies must compete with us by inventing their own technologies, not just by stealing ours,” said Bruce Sewell, Apple’s general counsel and senior vice president. Apple’s move comes in the wake of Nokia’s Oct. 22 compaint in the U.S. District Court in Delaware alleging the iPhone infringes on Nokia’s patents for GSM, UMTS and wireless LAN (WLAN) standards. Nokia has one of the strongest patent portfolios in the wireless industry with more than 10,000 patent families. Nokia has invested 40 billion euros (US$58 billion) in research and development in the last two decades. Many of Nokia’s patents undergird industry standards and Nokia licenses its patents to about 40 companies. Nokia alleges Apple infringed on intellectual property that relates to technologies fundamental to making devices compatible with one or more of the GSM, UMTS (3G WCDMA), and wireless LAN standards. The patents cover wireless data, speech coding, security and encryption, and Nokia said they are infringed by all Apple iPhone models shipped since the iPhone was introduced in 2007. “The basic principle in the mobile industry is that those companies who contribute in technology development to establish standards create intellectual property, which others then need to compensate for,” Ilkka Rahnasto, a Nokia vice president, said the day Nokia filed its suit. “Apple is also expected to follow this principle.
